All businesses, large and small, recognize that intellectual property is core to market entry, product differentiation and profitability. Yet intellectual property, as a legally created construct, suffers from the inherent unpredictability of any legal system. This unpredictability is increased both by the growing complexity of technology and the new jurisdictions (e.g., China) which have less well-developed (and thus less predictable) legal systems. This talk will explore the inherent unpredictability of intellectual property law and look at systematic approaches to improve predictability and reduce risk, such as patent process automation.
